Cake Portrait Terms and Conditions

Cake Portrait is provided by 10951811 Canada Inc. ("we", "us" or "our"). These terms govern cakeportrait.com, the customer portal and associated services for cake photography, design ideas and business content. By using the service, you agree to these terms. If you do not agree, do not use it.

Who may use Cake Portrait

You must be at least 18 and legally able to enter this agreement. If you use Cake Portrait for a bakery or organization, you confirm your authority to act for it. You are responsible for account activity and protecting your password and device access.

The portal uses a verified email and password account. Some branding and edited captions stay only in your browser. Signing in on another device does not recover browser-only information. Keep separate copies of important work. Public account-email delivery is not enabled in the current early-access period.

The service and AI results

Cake Portrait uses AI to assess and edit selected cake photos, suggest design ideas and draft captions. These features need internet access and available service capacity. Tools and limits may change, subject to applicable law and existing purchase rights.

AI can alter tiers, icing, colours, piping, decorations, toppers, lettering, people or surrounding details, even when you choose Preserve or Polish. A Ready result passed technical checks; it does not establish independent visual verification. Compare each result with your original and review all text before sharing.

Reimagined cakes and generated design ideas are proposals. They do not establish an actual completed cake, recipe, flavour, allergens, serving count, dimensions, stock or availability. You are responsible for accurate advertising, prices, customer promises and AI disclosures. Keep concept labels and do not present a generated design as a photograph of work you completed.

Your content and commercial use

You retain your rights in photos, logos, descriptions and other material you supply. You must have the rights and permissions needed to upload, process and share that material, including permission from identifiable people where required. Avoid unnecessary client information, confidential documents and sensitive personal information.

You give us a limited, non-exclusive licence to store, copy, transmit and process your submitted content, including through our service providers, only as needed to provide the features you request, protect the service and meet legal obligations. This does not give us permission to use your private content in public advertising. Personal information is handled as described in the Privacy Policy.

As between you and us, you may use, edit and share generated results for personal and commercial purposes, and we assign to you any rights we may hold in those results to the extent permitted by law. AI results may resemble other results or third-party material, may not qualify for copyright protection and are not guaranteed to be exclusive or free of third-party claims. You remain responsible for obtaining any rights needed for your intended use. App software, supplied examples and our branding remain ours or our licensors'.

Acceptable use

Do not use Cake Portrait to violate the law or another person's rights; create deceptive or unlawful content; upload material you are not entitled to use; exploit children; harass others; distribute malware; access another person's data; or bypass security, purchase verification, credits or service limits. Do not remove required proposal labels or Cake Portrait marks from enhanced exports to evade the plan restrictions. You may apply your own branding using the app's available tools.

Free credits and paid plans

Free includes three lifetime trial AI photos, with no payment card required. One technically valid new image uses one credit. Failed, retake or uncertain jobs release the image reservation. Dissatisfaction with a technically valid image does not automatically restore a credit, without limiting remedies required by law. Resizing, branding and exporting an existing image use no image credits. Ideas and captions have separate service limits.

The approved launch Premium offer is US$19.99 per month for 75 completed AI photos per monthly allowance period. It removes the Cake Portrait mark from enhanced exports while the subscription is active. Unused monthly photos do not roll over. The optional extra-photo pack is US$9.99 once for 25 photos; unused pack credits do not expire and remain associated with the purchasing account after a subscription ends. Concept and illustrative-example labels remain on every plan.

Paid web checkout is not active at present. Before purchases are enabled, the checkout will show the applicable price, currency, taxes, billing period, provider and offer terms. That checkout controls over an illustrative price elsewhere. We do not retroactively reduce purchased entitlements except as permitted by law or following a refund, reversal or revoked purchase. Deleting an account does not refill used credits; contact support about remaining paid credits.

Renewals and cancellation

When subscriptions are enabled, they renew automatically only under the renewal terms accepted at checkout. Cancel before the renewal deadline displayed at purchase through the provided billing controls, or contact support for help. Cancellation normally takes effect at the end of the paid period.

Closing a browser, stopping AI use, deleting content or requesting account deletion does not itself cancel a subscription. Keep purchase receipts and contact us if paid credits are missing. There is no active web subscription to cancel during the current pre-checkout period.

Refunds and purchase problems

Contact floral.studio@outlook.com with "Cake Portrait billing" about service failures, incorrect credit deductions or refund requests. When web payments are enabled, checkout will identify the payment provider and applicable refund process. Nothing in these terms removes statutory refund, warranty or consumer rights.

Privacy and sharing

The Privacy Policy explains the information we collect, the providers we use, your choices and how to request deletion. Agreement to these terms is not a substitute for a separate permission required for AI processing. Review the app's sharing notices before submitting content. Exporting or sharing sends the selected material to the destination you choose; its rules and privacy practices then apply.

Service interruptions and ending access

We may restrict or suspend access when reasonably needed to address security, fraud, unlawful activity, serious misuse or a legal requirement. Where practical and lawful, we explain the reason and provide a contact route. You may stop using the service and request deletion under the Privacy Policy. Suspension does not remove statutory remedies or itself cancel a subscription.

Delays, outages or data loss can occur. Keep your own exports and original photographs. We provide legally required notice and remedies for material changes or discontinuation affecting paid services.

Warranties and liability

To the extent permitted by law, we do not promise uninterrupted availability or that AI results will be accurate, unique or suitable for a particular purpose. Statutory warranties and rights that cannot lawfully be excluded continue to apply.

For business users, to the extent permitted by law, we are not liable for indirect or consequential losses or lost profits, and our total liability arising from the service is limited to the greater of CAD $100 and the amount you paid for Cake Portrait in the 12 months before the event giving rise to the claim. These exclusions and limits do not apply to consumers where prohibited, fraud, intentional or gross fault, bodily or moral injury, or any liability that the law does not allow us to limit.

Applicable law and disputes

These terms are governed by the laws of Quebec and the federal laws of Canada applicable there, subject to mandatory protections in your place of residence. Disputes may be brought before competent courts in Quebec, or another court where applicable law gives you that right. These terms do not require arbitration or waive a right to bring or join a class action. Contact us first if you would like help resolving a problem.

Changes to these terms

We will show an updated date when we change these terms and provide notice of material changes through the app or another appropriate channel. Changes apply prospectively, with any notice, consent, cancellation or refund rights required by law. Continued use does not waive a right that requires your express consent. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
